1. Scope of Application

These General Terms and Conditions apply to all contracts between Jonas Hempel (hereinafter referred to as "Video Editor") and his clients. Deviating terms of the client will only be recognized if confirmed in writing.

2. Contract Formation

A contract is established once the client explicitly confirms the Video Editor's offered service – for example via email or WhatsApp – and the Video Editor declares acceptance or begins executing the work.

3. Scope of Services

The Video Editor provides services in video editing, color correction, animation, and other post-production work. The exact scope of services is individually agreed upon for each project. After full payment, the client receives unrestricted usage rights to the created content.

4. Client Obligations

The client commits to providing all materials necessary for project completion in a timely manner and suitable format. The client confirms having all required rights to these materials and that no third-party rights are violated.

5. Corrections and Changes

Two revision rounds are included in the agreed price. Additional changes will be charged separately based on effort. After payment is made, the project is considered complete; subsequent adjustments or changes are excluded.

6. Compensation and Payment

Payment is due after project completion and invoice receipt. Payments are due within 14 days of invoicing without deductions. Delivery of final materials may be withheld until payment is received.

7. Usage Rights and Portfolio

Upon full payment, the client receives unrestricted usage rights to the created videos. The Video Editor reserves the right to showcase completed projects for reference purposes on their website, social media, or portfolio presentations.

8. Liability

The Video Editor is only liable for damages resulting from intentional or grossly negligent behavior. The Video Editor assumes no liability for materials provided by the client. The client indemnifies the Video Editor against all third-party claims.

9. Data Protection

Personal data is processed exclusively for contract fulfillment. Further information is provided in a separate privacy policy.

10. Final Provisions

German law applies. Place of jurisdiction is Rostock. Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected.

2. Data Collection and Usage

We collect and use personal data from our clients exclusively for contract fulfillment and project execution. This includes in particular: name, contact details (e.g., email, WhatsApp), and all materials provided by the client.

3. Processing of Video Material

As part of project execution, we process videos that may contain personal data (faces, voices, etc.). This data is used exclusively for creating, editing, and delivering the agreed project.

4. Communication

We use E-Mail, WhatsApp, Instagram or Signal for project coordination and material exchange. All messages are stored for the traceability of agreements.

5. Storage and Deletion

Customer data and video material are stored locally on an external hard drive.

Storage: maximum 5 years, unless the customer requests deletion.
Deletion: Customers can request deletion of their data or materials at any time.
Portfolio: Unless immediate deletion is requested, videos may be used for reference and portfolio purposes.

6. Disclosure to Third Parties

Data is only shared with service providers necessary for project execution (e.g., cloud storage, external processing), and only to the extent contractually or technically required. Disclosure for other purposes does not occur.

7. Rights of Data Subjects

Customers have the right at any time to:

• Information about stored data
• Correction of incorrect data
• Deletion of their personal data
• Revocation of consent, e.g., for portfolio use

8. Security

We implement appropriate technical and organizational measures to ensure the security of personal data and prevent unauthorized access.

9. Changes to This Policy

We reserve the right to update this privacy policy. Changes will be published on our website.

10. GDPR Compliance

The processing of personal data is always carried out in accordance with the General Data Protection Regulation (GDPR).
